Overview

The Department of Environment, Land, Water and Planning (DELWP) seeks your comment and feedback on the proposed Water (General) Regulations 2021. These Regulations incorporate and update the:

  • Water (Subdivisional Easements and Reserves) Regulations 2011 which are due to expire on 15 March 2021. These Regulations prescribe the rights that attach to subdivisional easements and reserves created under the Water Act 1989. No significant changes are proposed to the current Regulations.   • Water (Register of Interests) Regulations 2010 remade as Water (Register of Interests) Regulations 2020 which are due to expire on 3 August 2021. These Regulations assist with compliance and promote good governance of water corporations and similar entities. Comment here.
  • Water (Notice of Disposition of Land) Regulations 2010 remade as Water (Notice of Disposition of Land) Regulations 2020 which are due to expire on 3 August 2021. These Regulations prescribe the form of the notice of disposition of land that must be provided to water corporations when land or property is sold or transferred. Comment here.
  • Water (Long Service Leave) Regulations 2011 which are due to expire on 3 August 2021. These Regulations prescribe the methods for the calculating and taking of long service leave for water corporation employees. Changes proposed are primarily about portability and reflect current Victorian public sector entitlements. Comment here.

Consolidating the above four current Regulations into one single Regulation will be more efficient and reduce the number of Regulations under the Water Act 1989.

The new Water (General) Regulations 2021 are intended to commence no later than 15 March 2021.
