Maritime Safety Victoria (MSV) is seeking feedback on a draft Code of Practice (the Code) developed to help managers of boating activity events (any event that directly or indirectly involves a vessel, for example a kayak race or open water swimming race with support vessels) comply with a safety duty introduced in 2018.
The safety duty, introduced under Section 25A of the Marine Safety Act 2010 (Vic), requires employers, or self-employed people, who are organising or managing an event (duty holders) to ensure the safety of participants and bystanders so far as is reasonably practicable. Individual employees or volunteers are not subject to the safety duty.
The Code was drafted, in consultation with a cross section of peak sporting and recreation bodies and other Victorian agencies, to help duty holders understand and meet the legal requirements of the safety duty.

All feedback will be considered and, where appropriate, incorporated into the final version of the Code.
A ‘response to feedback’ statement will be published following consultation, and the final version of the Code will be available on the MSV website once signed by the Minister for Fishing & Boating.
