On 17 February 2021, EPA Victoria (EPA) received a works approval application from Prospect Hill International Pty. Ltd. (Prospect Hill). The company is proposing to develop a waste-to-energy facility at 164-200 McManus Road, Lara VIC 3212.

What does the application propose?

The application proposes a waste-to-energy facility in Lara to service greater Geelong and west metropolitan Melbourne. The facility will be designed to process approximately 400,000 tonnes of waste per year and generate 35 megawatts of electricity. Prospect Hill estimates this is enough to power up to 50,000 homes. The facility will only take residual wastes currently destined for landfill.

The application includes technical studies of the potential impacts of the proposal including:

  • comparison with international best practice standards for waste-to-energy facilities
  • human health impact assessment
  • air and odour emissions
  • noise emissions
  • greenhouse gas emissions
  • incoming and outgoing waste management.

The proposed facility requires a works approval because it falls under the A08 (Waste to energy) and K01 (Power stations) categories of the Environment Protection (Scheduled Premises) Regulations 2017.

The company cannot begin works on the facility until it has obtained a works approval. If EPA issues a works approval, the company will also need to apply and be issued with a licence to operate the facility.

Latest updates

Current status

On 12 May 2021, EPA issued Prospect Hill with a notice requesting further information. The request was to respond to public submissions and referral agency letters. Following the community conference on 13 July 2021, EPA also required a response to the conference chair's report and recommendations.

EPA has now received a response from Prospect Hill to the submissions and the conference report. These are available under the ‘supporting document’ section of this page. EPA will now incorporate the response into its assessment of the application.

Second submission period

EPA invites the community and interested parties to comment on the application as part of a second submission period. This submission period will be open from 13 October 2021.

The submission period will close at 11.59PM, 28 October 2021.

Next steps

The next steps in EPA’s assessment process are:

  • EPA will consider the conference report and recommendations as part of its assessment of the application.
  • EPA will complete its technical assessment of the application including:
    • assessing for compliance against legislative requirements of the Environment Protection Act 2017 and the Environment Protection Regulations 2021
    • analysing key issues to determine likelihood of pollution and hazard occurring.

Once a decision is made to approve or refuse, EPA will notify all submitters and publish the Assessment Report on Engage Victoria.

New Laws

On 1 July 2021, the new Environment Protection Act 2017 and Environment Protection Regulations 2021 commenced. These laws introduce a new environment protection regulatory model for Victoria.

These new laws include a new permissions scheme. Under this scheme, works approvals are replaced by development licences.

Previous updates

EPA thanks all those that attended and participated in the Prospect Hill conference of interested persons held on 13 July at Lara Masonic Hall, 37-39 Rennie St, Lara VIC 3212. EPA values the many contributions made by the community of Lara.

The purpose of the conference was to:

  • enable EPA to listen to, and better understand, the views and concerns of the community and stakeholders
  • help explain to attendees the development licence application, the assessment process, and its current status
  • discuss ideas about possible conditions if the development licence is issued.

The conference was independently chaired. Following the conference, the Chair prepared a report reflecting the issues and concerned raised on the night.

The report also includes recommendations to Prospect Hill and EPA. EPA is required to consider the Chair’s recommendations as part of its assessment of the development licence application.

Next steps

The next steps in EPA’s assessment process are:

  • EPA will consider the conference report and recommendations as part of its assessment of the application.
  • EPA will complete its technical assessment of the application including:
    • assessing for compliance against legislative requirements of the Environment Protection Act 2017 and the Environment Protection Regulations 2021
    • analysing key issues to determine likelihood of pollution and hazard occurring.

Once a decision is made to approve or refuse, EPA will notify all submitters and publish the Assessment Report on Engage Victoria.

Prospect Hill and their project team will be available for face-to-face engagement prior to the Community Conference on Tuesday 13 July 2021.

They will be available to answer any questions and provide information for interested community members.

After reviewing the submission, EPA has made the decision to hold a conference of interested persons to ensure it understands community concerns withe the development proposed by Prospect Hill International Pty Ltd.

The purpose of the conference is:

  • for EPA to gain a better understanding of community concerns and issues that need to be considered
  • to inform the public on EPA's assessment process
  • to identify potential resolutions for any issues in the application

The conference will be independently chaired. EPA must consider the recommendations of the report as part of its decision on whether or not to approve the development licence application.

Once prepared, the report will be made available in the supporting documents section of this page.

  • enable EPA to listen to, and better understand, the views and concerns of the community and stakeholders,
  • help explain the works approval application, the assessment process and its current status,
  • discuss ideas about possible conditions if the works approval is issued.

The conference will be independently chaired. After the conference, the chairperson will prepare a report detailing community concerns, including recommendations for EPA to consider as part of its assessment of the works approval application.

Due to the new public health measures announced today and earlier this week by the State Government of Victoria, EPA has made the decision to postpone the s20B community conference for the Prospect Hill works approval application. The event was to be held on Tuesday 1 June 2021 at the Lara Masonic Hall.


EPA felt it necessary to postpone the event for the following reasons:

  • the interest of public safety
  • to minimise disruption caused by new public health restrictions
  • to be able to hold an event that achieves the best possible consultative outcome
  • the need to provide sufficient notification for any change to an online event if that is required.

Our hope is to be able to hold a face-to-face event in mid-June, however if health measures are still in place, we will proceed with an online event in the best format possible to achieve a strong consultative outcome.

On 12 May 2021, EPA issued Prospect Hill with a notice under section 22 of the Environment Protection Act 1970. The notice requires the company to supply a response to the submissions and referral letters received by 19 May 2021.

The submission period for this works approval closed on 28 April 2021. During this period, EPA received 63 submissions, 59 of these objecting to the proposed works.
